As Americans head to the polls this November in the 2022 midterm elections, Preservation Action is surveying all 2022 congressional candidates for the U.S House of Representatives and the U.S Senate. Our goal is to inform voters on where their candidates for office stand on the National Historic Preservation Program. Historic preservation enjoys strong bipartisan support and is widely embraced as an important federal policy objective. Across every state and Congressional district, there are dozens of organizations with thousands of members who care about cultural heritage and community revitalization. The collective national reach across our network of state, tribal, and local historic preservation organizations is over 750,000 people. 

If you would like voters to know your positions on historic preservation, please return this survey by September 15, 2022. 

In a grassroots survey of the general public and historic preservation advocates, respondents overwhelmingly indicated preservation to be a priority in their community. Respondents indicated that two of the most important federal policy issues concerning historic preservation were preserving and enhancing the Federal Rehabilitation Tax Credit, better known as the Historic Tax Credit (HTC), and robust funding for the Historic Preservation Fund, which supports State and Tribal Historic Preservation Offices and several competitive grant programs.

The National Historic Preservation Act (NHPA), which helped establish our federal historic preservation program, was signed into law by President Lyndon B. Johnson in 1966 after the destruction of numerous buildings, sites, and neighborhoods in the years following World War II. The NHPA established a series of programs to encourage the preservation of irreplaceable historic resources including the National Register of Historic Places and the Advisory Council on Historic Preservation. The National Park Service operates as a lead participant in the multi-tiered program with other federal agencies, State Historic Preservation Offices, Tribal Historic Preservation Offices, and Certified Local Governments. These partners advance federal programs such as matching grants, the HTC program, and others.

Preservation Action does not assign grades and does not endorse candidates. Instead, we plan to widely disseminate the results of this survey to our national network of preservation advocates – including state, tribal and local preservation organizations,  as well as individuals – ahead of the November midterm elections.

Historic Preservation Fund Background:


The Historic Preservation Fund was established in 1976 to help carry out the National Historic Preservation Act. The responsibilities of the HPF are largely handled by State and Tribal Historic Preservation Officers, who administer the federal historic preservation program including, review of federal infrastructure projects, nominations to the National Register of Historic Places, grants to Certified Local Governments, and administering the Historic Tax Credit. In recent years, the HPF has also supported competitive grant programs like African American Civil Rights grant program, the Save America’s Treasures program, the Paul Bruhn Historic Revitalization grant program, Tribal Heritage grants, and grants for underrepresented communities. 

The HPF is uniquely funded through a percentage of offshore oil lease revenue, not tax-payer dollars. In FY 2022, Congress appropriated $173 million for the Historic Preservation Fund. The Historic Preservation Enhancement Act (H.R. 6589), introduced earlier this year, would permanently reauthorize the Historic Preservation Fund and fully fund the program at $300 million annually. The current HPF program, which expires at the end of FY2023, is authorized to receive $150 million in funding annually.

Historic Preservation Fund Comments:

History is important whether it be all forms of events & celebrations; media: books, magazines, documents radio, TV, video, social media; and physical structures, locations or environments!  Without history we will not only not know where we came from, but we won’t know where we are going!  History is our compass and map! That is why I support the Historic Preservation Fund.

Historic Tax Credit Background:


Legislation modernizing the Federal Rehabilitation Tax Credit (HTC) was signed into law by President Ronald Reagan in 1981 as an incentive to catalyze economic development through the rehabilitation and reuse of America’s historic buildings. The credit is the largest federal investment in historic preservation, and it is market driven. The 2017 Tax Cuts and Jobs Act retained the 20% credit but altered the program, requiring the credit to be taken over 5 years. The Historic Tax Credit Growth and Opportunity Act (S.2266/H.R 2294) includes several provisions designed to enhance the HTC and make it more accessible.

Past IRS revenue procedures, guidance, as well as recent federal policies have diminished the value of the HTC by up to 20%. This compounded with current inflation challenges and skyrocketing cost of materials, there has been a decline in use of the credit in FY2021.

These changes are aimed at stimulating the economy and making it easier for smaller projects as well as non-profits to take advantage of the credit. The HTC returns more to the Treasury than the cost of the program. A study from the National Park Service concluded that the Historic Tax Credit has generated $39.4 billion in federal tax revenue from $34.3 billion in federal tax credits.

Historic Tax Credit Comments:

I am concerned about how few Senators and Congresspersons are co-signers and the lack of many of the more progressive ones.   As an individual without staff, it is always hard to understand bills fully and to know if there are poison bills in an otherwise good bill.  I support efforts to improve the preservation of historical structures and places in principle.

Historic Preservation Protections Background:


Legislation like the National Historic Preservation Act and National Environmental Policy Act help to ensure that historic and tribal cultural resources are considered as part of the federal project planning process. While neither law mandates a specific outcome, they are designed to provide citizens with the opportunity to provide input into the federal decision-making process. This is especially important as the recently passed Infrastructure Investment and Jobs Act is implemented.

My 2022 Campaign Statement on ERA

I fully support passage of the ERA!  Still, not a U.S. Constitutional Amendment, the Equal Rights Amendment is designed to guarantee equal legal rights for all American citizens regardless of sex.

It is outrageous that it has been nearly 100 years since the Equal Rights Amendment (ERA) was first introduced in the U.S. Congress shortly after the passage of the 19th Amendment granting women the right to vote. 

It has been over 50 years since the U.S. House and Senate passed the ERA and it was submitted to the state legislatures for ratification, as provided by Article V of the U.S. Constitution. 35 of the necessary 38 state ratifications were secured by 1977 and in recent years the remaining necessary 3 state ratifications were obtained.

Originally, the ERA had wide, bipartisan political support, but many conservatives and Republicans have become hostile to the ERA.

Currently the ERA is surrounded by legal uncertainty about the consequences of the Virginian ratification, due to expired deadlines and five states’ revocations.   

I will actively support a positive resolution of these legal uncertainties to finally have passage of the ERA as a Constitutional Amendment!

Living in the SF Bay Area in her later years, Cecile Pineda left an incredible footprint, both with her writing, her activism and as an artist and former theater director.

She was often in the streets for local and global peace & justice causes.  She participated in weeklong Shut Down Creech drone resistance actions for years, even when her advanced age limited the capacity of her participation.  She was an amazing and accomplished writer and blogger with a deep devotion to many peace & justice causes.  Read her most recent blog, on homelessness HERE. Author, playwright, director, mother, and blogger Cecile Pineda has passed into history 

and I am one of legions who will miss her. Her wit, clarity, and courage to tell us hard truths were valuable, and it was my great honor to be mentored by Cecile in my own blogging career.

In memoriam, I dedicate this blog post to Cecile and as homage I will mimic a couple of the structures she employed in her blog/newsletter: Take Action, and This Week’s Roses Amidst the Thorns. I’m sure that by including these sections in each post, she hoped to offset the despair and cynicism that can overtake those who pay attention to current events.

Cecile’s most recent book 

is not listed in the bio on her website, probably because she was slowing down a bit in recent years (she was about to turn 90).


A memoir, Entry Without Inspection: A Writer’s Life in El Norte (University of Georgia Press, 2020) examined the personal and political influences in the life of a self-identified Chicana author who won numerous awards for her fiction: the Sue Kaufman Prize for First Fiction, a gold Medal from the Commonwealth Club of California, and a National Endowment for the Arts Creative Writing Fellowship. She also, as a married mother, took it as her duty to have dinner on the table every night. She was also a director and performer of distinction who chronicled the declining support for theater that explored the bounds of dramatic possibility rather than striving for commercial success. She was also the child of immigrant parents who forged her own identity in the face of some spectacularly bad parenting. And, typical of her ability to locate the personal within the political, she depicted the catastrophic effects of U.S. immigration politices via her father’s experience plus the story of a whistleblower who revealed the death of an immigrant while in ICE detention.

I enjoyed this book very much as I knew Cecile by the time I was reading it, and because her life at the borders of second wave feminism and 20th century immigration policies was illuminating — at least the way she tells it.

Even more influential on my thinking: 

her two previous books, also non-fiction.

Apology to a Whale: Words to Mend a World (Wings Press, 2015) is categorized as philosophy and attracted some illustrious blurbs when published. I’ll let one from a prominent environmentalist speak for itself:

Cecile Pineda has the nerve to ask the one simple question that eludes our public posturing….It is the one question that could save us: 

What has happened to our mind that we are killing our world? 

What is it, at the root of our culture that sets us against the rest of creation? 

The genius of this book is that the question [itself] supersedes the answers and takes us on explorations where we make our own discoveries. These widening apprehensions not only pierce us with heartache for what we have lost, but invite us to examine the imprisoning structures of the very language we use. 

Cecile Pineda has the rare and enviable capacity to address the big questions without falling into abstractions or sermonizing. It is the artist in her that I trust, and that utters so potent a call to personal and collective liberation.

Cecile’s book with the biggest impact for me, personally, was undoubtedly this one. 


Devil’s Tango: How I Learned the Fukushima Step by Step (Wings Press, 2013) argued a thesis that acted as a tsunami demolishing my lifelong dread of nuclear war. It’s not that I don’t still dread it (and notice it creeping closer with each passing day), it’s that I followed Cecile’s carefully reasoned argument that nuclear holocaust is already here. Constant pollution from radiation leaks, accidents, and deliberate use of ordnance composed with depleted uranium already have global cancer rates and birth defects skyrocketing. Continuing to build nuclear power plants and nuclear weapon systems without any meaningful plans for containing the waste, much less the radiation produced by accidents, is collective suicide. Fukushima was a disaster waiting to happen and another earthquake could replicate it on any of several coasts around the planet. 

I am deeply grateful to Cecile for both educating me and stimulating my ability to hold unwelcome truths in mind without succumbing to despair.

No safety issues have been identified, Moderna said about the lots that were distributed in Norway, Poland, Portugal, Spain and Sweden in January. 2022-04-05 West Virginia Removes Dozens of Deaths From COVID Count West Virginia has removed dozens of deaths from its official COVID-19 count after a review found nearly all of them were not related to the coronavirus, health officials said Tuesday. The Department of Health and Human Resources said Bureau for Public Health epidemiologists completed what it called a reconciliation process for 2021 that looks at all COVID-19 death reports. Of the 3,948 deaths reported in 2021, 122 deaths, or 3%, were determined not to be virus-related. 2022-04-05 COVID Vaccines Will Soon Be Available for Kids Under 5. Experts Worry Many Parents Won’t See the Need. What’s worse for public health officials staring down a possible new wave of infections from another Omicron subvariant called BA.2 is the fear other parents won’t see a need to get their kids vaccinated when the U.S. Food and Drug Administration authorizes it for children under age 5, as soon as April. ​​The percentage of fully vaccinated Americans has stagnated at about two-thirds. Just under half of those eligible have gotten a booster dose. Federal regulators authorized a second booster last week for older and immunocompromised people, but it’s unclear how many people will want those either. 2022-04-05 Pfizer Hired 600+ People to Process Vaccine Injury Reports, Documents Reveal Pfizer hired about 600 additional full-time employees to process adverse event reports during the three months following authorization of its COVID-19 vaccine, with plans to hire 1,800 more by June 2021, newly released documents reveal.

Remarking upon this newly revealed information, Brian Hooker, chief scientific officer of Children’s Health Defense, told The Defender: “The rollout of the Pfizer vaccine has led to an unprecedented number of adverse events reported — 158,000 adverse events in the first two-plus months of the rollout means that the rate of reported AE [adverse events] was approximately 1:1000, with many of the AEs graded as serious. This is based on a denominator of 125,000,000 vaccines distributed. “It is no wonder that an army of 1,800 individuals was needed to process all of the information.”

2022-04-04 FDA Says COVID Vaccines May Need to Be Updated to Ensure High Level of Effectiveness Against Virus The currently approved COVID-19 vaccines may need an update to ensure a high level of protection as the virus continues to evolve, according to the Food and Drug Administration. The FDA, in a briefing document published ahead of an advisory committee meeting this week, said scientists still don’t entirely understand COVID variants and the effectiveness of the vaccines. For example, mutations to the spike protein, which is used by the virus to invade human cells, have reduced the effectiveness of current vaccines. That’s because today’s COVID shots were developed to target the spike protein in the original strain of the virus that emerged in Wuhan, China in late 2019. The FDA’s advisory committee of outside vaccine experts on Wednesday will discuss how the U.S. can develop a transparent process to make recommendations about changing the composition of the current ones if needed. Pfizer and Moderna are conducting clinical trials on vaccines based on the Omicron variant, the dominant version of the virus worldwide. Among its findings was an alarmingly high number of U.S. teens reporting emotional abuse at home: more than half. Defined by the survey as being sworn at, insulted or put down by a parent or other adult in their home, 55 percent of the more than 7,700 high school students polled said they had experienced emotional abuse. 2022-04-01 Class-Action Lawsuit Challenges Firing of 66 Unvaccinated Workers at Akron Children’s Hospital Akron Children’s Hospital is “confident” that its firing of dozens of unvaccinated employees will withstand a federal class-action lawsuit. And the attorney making a First Amendment issue of the matter is already preparing for an appeal. The lawsuit names two lead plaintiffs: certified surgical technologist Brian Tessane and help desk worker Richard Brimer. Tessane worked five years at Akron Children’s Hospital and Tessane for two years before each was let go in late January, about two weeks after missing the hospital’s deadline for all staff members to get their initial COVID-19 vaccine shot. The plaintiffs, according to the lawsuit, were denied “reasonable accommodations” due to their Christian faith. 2022-04-01 Fauci Flashback: ‘The Most Potent Vaccination Is Getting Infected Yourself’ Throughout the pandemic, a large contingency of doctors, researchers and non-mainstream media outlets have been pounding the table over natural immunity as an alternative to vaccination to protect against COVID-19, with the obvious conclusion that vaccine passports are moot if a large percentage of the population has a higher degree of protection than even the vaccinated because they’ve already had the disease. Congress is two weeks away from the month-long August recess. House appropriators this week are advancing numerous fiscal year 2023 appropriations bills. At the same time, the Select Committee to Investigate the Jan. 6th Attack on the Capitol is holding its 8th public hearing set to focus on former President Trump’s dereliction of duty that day. On the other side of the Capitol, Senators continue to move towards both a possible reconciliation bill and a bill to bolster chip manufacturing in the U.S.

The House will vote on ten suspension bills from the Committees on Natural Resources and Foreign Affairs. Suspension bills require a ⅔ majority to pass. For a list of all suspension bills being considered, click here

The House will also consider the following bills, subject to rules:

H.R. 8294 – Transportation, Housing and Urban Development, Agriculture, Rural Development, Energy and Water Development, Financial Services and General Government, Interior, Environment, Military Construction, and Veterans Affairs Appropriations Act, 2023 (Rep. DeLauro – Appropriations): The bill combines six annual spending bills into one “minibus” appropriations bill, with a total topline figure of around $560 billion. The minibus would provide the large increases sought by President Joe Biden in his budget request, which proposed a 14% overall increase for nondefense programs. 

H.R. 8373 – Right to Contraception Act (Rep. Manning – Energy and Commerce): The bill would make law the right for people to obtain contraceptives and for health care providers to provide contraceptives. The bill would also protect a range of contraceptive methods, devices, and medications used to prevent pregnancy, including but not limited to oral contraceptives, emergency contraceptives, and intrauterine devices.

Johnson): The Senate this week is expected to consider a procedural vote on a China competition bill that would include $52 billion in incentives and an investment-tax credit to attract chip companies to the US, along with money for training and wireless technology. The package is expected to be narrower than initially envisioned, as Minority Leader Mitch McConnell has pledged to stonewall more comprehensive legislation while Senate Democrats pursue a reconciliation bill.

Reconciliation Talks

Last week, Senator Joe Manchin (D-WV) announced that he would not presently support a reconciliation bill that contains the climate, energy, or tax provisions sought by President Biden, citing the June inflation figures. Instead, he is willing to support a bill that allows Medicare to negotiate drug prices and extends Obamacare subsidies for two years. While the timeline remains unclear, the Senate might be able to move forward with a bill as early as next week once the legislative text to lower prescription drug prices is approved by the Senate Parliamentarian. If this happens, the bill would undergo a week-long “vote-a-rama,” where Senators will attempt to amend the bill before a final Senate vote. The House, which is expected to break on July 29 for the August recess, will then have to pass the same bill. The reconciliation instructions are set to expire at the end of this fiscal year, making September 30 the hard deadline for any reconciliation bill. 

January 6th Committee Public Hearings

The House Select Committee to Investigate the January 6th Attack on the Capitol is continuing their public hearings this week. On Thursday, the Committee is expected to focus on the timeline from when the attack on the Capitol began to when former President Donald Trump told his supporters to leave the complex. This hearing will be the eighth in the series so far, but the Committee will continue its investigation until the release of their report expected this fall. 

House Unionization 

Staffers from eight different congressional offices are expected to file petitions with the Office of Congressional Workplace Rights to form unions today. This follows the successful passage of H. Res. 1096 in May, which grants congressional staff the right to organize and bargain collectively with protections. It is important to note that only House staffers will have the ability to unionize with protections from retaliation. The Senate would have to pass their own resolution allowing Senate staff the same protection.

The Anci District of Langfang city, in northern China, on Wednesday ordered the “complete culling of indoor animals” of coronavirus patients, the state-run China News Service reported. The work had stopped by 5 p.m. local time Wednesday, the China News Service reported, citing a staff member for the Langfang Center for Disease Control and Prevention. It is not clear how many animals were killed. 2022-03-29 FDA Authorizes Fourth Pfizer and Moderna COVID Vaccine Doses for 50 and Older The Food and Drug Administration has authorized fourth Pfizer and Moderna COVID vaccine doses for everyone age 50 and older, amid uncertainty over whether an even more contagious version of Omicron will cause another wave of infection in the U.S. as it has in Europe and China. The FDA also said it authorized a second Pfizer booster shot for people age 12 and older who have compromised immune systems, and a second Moderna booster for adults ages 18 and older with compromised immune systems. The new boosters are administered at least fourth months after the last shot. The FDA made the decision without a meeting of its vaccine advisory committee, a rare move the agency has made more frequently over the course of the pandemic to expand the uses of already-approved COVID vaccines. People who reported tinnitus ranged in ages from 19 to 91, and nearly three-quarters were women. The reports came from 27 countries, including Italy, the United Kingdom and the United States. More than a third were reported among those working in the healthcare industry. There is no known cause for tinnitus, and so far, there is no proof that the vaccines may cause any hearing problems, according to the WHO, the Centers for Disease Control and Prevention, and companies that manufacture the vaccines.
